Right-to-work confirmation
Overview

In an attempt to ensure that any worker engaged for work in the UK has the right to work in the UK, the UK Border Agency [UKBA] introduced their prevention of illegal working legislation.

This legislation puts obligations on employers to check that any worker they engage has the right to work in the UK.

As a result of these obligations, umbrella providers, agencies and end clients are all now applying checks to some degree. The essential requirement is the fact that any worker must be met face-to-face, presenting their relevant documentation at the meeting. This single aspect is possibly the most challenging part of the requirements for the flexible workforce market.

Where an umbrella, agency or end client is unable to fulfil these obligations they are exposed to the potential of fines if an illegal worker is engaged.

An unintended consequence of the legislation is the increased risk of identity theft faced by contractors.

Professional Passport has worked closely with the UKBA, trying to address this issue for the flexible workers market.

We have agreed processes to help all parties to meet and demonstrate that the obligations have been carried out.

We are now able to confirm the validity of the right to work for many contractors.

Confirming your right to work gives umbrellas, agencies and end clients a simple way to validate your right to work and meet their obligations.
